Landlord Responsibilities

As a landlord, ensuring the safety and well-being of your tenants is paramount. To fulfill your obligations, it is essential to adhere to the following responsibilities:

  • Gas Safety Check: Arrange for a gas safety check to be conducted every 12 months by a Gas Safe registered engineer. This ensures that gas appliances and fittings in your property are safe for use.

  • Furniture Safety: Ensure that any furniture provided in the property meets the required safety standards. This includes beds, sofas, and other furnishings that you supply to your tenants.

  • Electrical Equipment Safety: Ensure that all electrical equipment provided in the property meets the necessary safety standards. Regular checks and maintenance of electrical appliances are crucial to prevent hazards and ensure tenant safety.

  • Smoke Alarms and Carbon Monoxide Detectors: Install smoke alarms on each floor of your property and carbon monoxide detectors in any room with a coal fire or wood-burning stove. Regular testing and maintenance of these devices are essential to protect against fire and carbon monoxide poisoning.

  • Energy Performance Certificate (EPC): Obtain an Energy Performance Certificate (EPC) for your property. It is a legal requirement for privately rented properties in Wales to have a minimum EPC rating of E for new lets and renewal tenancies, unless exempt. Failure to comply with this regulation may result in a fine of £5,000 from the local authority.

Rent Smart Wales

What is Rent Smart Wales?

Rent Smart Wales is a government initiative established under the Housing (Wales) Act 2014. It aims to regulate the private rented sector in Wales and ensure that landlords meet their legal obligations.

Landlord Registration

Under the Housing (Wales) Act 2014, all landlords with properties in Wales are required to register with Rent Smart Wales. Additionally, landlords who are ‘self-managing’ must obtain a license, or alternatively, use a licensed agent to manage their properties.

Consequences of Non-Compliance

Failure to register with Rent Smart Wales, obtain a license if self-managing, or use a licensed agent can result in penalties. Rent Smart Wales has the authority to issue fixed penalty fines to landlords who do not comply with their obligations. Furthermore, non-compliance may lead to the loss of a landlord's license.
